1. Agreement to Terms

By creating an account and using f(x) Scotland (the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by E & M Engineering Consulting Ltd, a company registered in Scotland.

If you do not agree to these Terms, you must not use the Service.

2. Description of Service

f(x) Scotland is an AI-powered online maths tutoring platform designed to help students prepare for Scottish Qualifications Authority (SQA) examinations at National 5, Higher, and Advanced Higher levels.

The Service provides:

• Interactive AI tutoring conversations
• Step-by-step problem solving guidance
• Coverage of Scottish mathematics curriculum
• Mathematical notation rendering (LaTeX)

3. Eligibility

You must be at least 13 years old to use this Service. Users between 13-16 years of age should have parental consent and supervision. By creating an account, you represent that you meet these age requirements.

4. Account Registration

To use the Service, you must:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You may not share your account credentials or allow others to access your account.

5. Subscription Plans and Payment

5.1 Plans

We offer the following subscription plans:

• Individual Plan: £15/month for individual student access
• School Plan: £500/month for unlimited student accounts within a school
• Free Trials: May be offered via promotional codes

5.2 Billing

• Subscriptions are billed monthly in advance
• Payment is processed securely via Stripe
• All prices are in British Pounds (GBP) and include VAT where applicable
• You authorize us to charge your payment method for recurring monthly fees

5.3 Automatic Renewal

Your subscription will automatically renew each month unless you cancel before the renewal date. You will be charged the then-current subscription fee.

6. Cancellation and Refunds

6.1 Your Right to Cancel (Consumer Rights)

Under the Consumer Contracts Regulations 2013, UK consumers have a 14-day cooling-off period from the date of purchase. However, by using the Service immediately after purchase, you acknowledge that you waive your right to the cooling-off period for that month's subscription.

6.2 Monthly Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial months
• You retain access to the Service until the end of your paid period

6.3 Refund Policy

Refunds are generally not provided except:

• Within the 14-day cooling-off period if you have not used the Service
• In cases of technical failure preventing Service use
• At our sole discretion for extenuating circumstances

7. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Share your account with others or create multiple accounts
• Attempt to circumvent payment or access restrictions
• Use automated systems (bots) to access the Service
• Reverse engineer, decompile, or extract source code
• Reproduce, copy, or resell any part of the Service
• Use the Service to generate content that violates exam regulations
• Submit inappropriate, offensive, or harmful content
• Attempt to interfere with the Service's security or operation

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by E & M Engineering Consulting Ltd and protected by UK and international copyright and trademark laws.

Your Content: You retain ownership of questions and content you submit. By using the Service, you grant us a license to process your content to provide the Service and improve our AI models.

9. AI-Generated Content

Our Service uses OpenAI's GPT technology. While we strive for accuracy:

• AI responses may contain errors or inaccuracies
• Responses are for educational guidance only
• We do not guarantee the correctness of all AI-generated content
• You should verify important information with authoritative sources
• We are not liable for decisions made based on AI responses

10. Service Availability

We aim to provide continuous service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency repairs
• Third-party service disruptions (e.g., OpenAI, Stripe)
• Circumstances beyond our control

We will provide reasonable notice of planned maintenance where possible.

11. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the Service in a manner that harms us or other users

Upon termination, your access to the Service will cease, and your data may be deleted in accordance with our Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by UK law:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee exam success or specific learning outcomes
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be limited under UK law

13. Consumer Rights (UK)

If you are a consumer in the United Kingdom, you have legal rights under the Consumer Rights Act 2015. These Terms do not affect those statutory rights. Digital content must be:

• As described
• Fit for purpose
• Of satisfactory quality
